تحكم الشروط والأحكام التالية (يُشار إليها فيما يلي باسم "الشروط والأحكام") العملية الكاملة للمشاركة في " "مسابقة فيلم مملكة كوكب القرود" (يُشار إليها فيما يلي باسم "المسابقة") حيث تكون هذه الشروط والأحكام ملزمة لكل مشارك (يُشار إليه فيما يلي باسم "المشارك"، "الخاص بك" " و/أو "أنت") المقيم في دولة الإمارات العربية المتحدة ("الإقليم") ممن يرغب طوعًا في المشاركة في المسابقة التي تستضيفها شركة ستار آسيانيت ميدل إيست منطقة حرة – ذ.م.م مع الشركات التابعة لها والشركاء والوكالات وما إلى ذلك، حسب مقتضى الحال (يُشار إليهم فيما يلي بشكل جماعي باسم "الشركة") وتحدد ، من بين أمور أخرى، شروط مشاركتك في المسابقة واختيار الفائز في المسابقة.

وتُعد مشاركتك في المسابقة بمثابة موافقتك المطلقة على القواعد واللوائح وهذه الشروط والأحكام وسياسة الخصوصية المتوفرة على [https://www.disneystar.com/legal-terms-policies/terms/contest-terms-conditions/wish-movie-contest-same-privacy-policy/] (يُشار إليها فيما يلي باسم "سياسة الخصوصية") كما تحددها الشركة من وقت لآخر (يشار إليها فيما يلي بشكل جماعي باسم "شروط المسابقة"). فعند قيام أحد المشاركين بإرسال المشاركة إلى الشركة، عندئذٍ يجوز للشركة، وفقًا لتقديرها الخاص، مشاركة رابط لهذه الشروط الخصوصية. وتُعد مشاركتك المستمرة في المسابقة بمثابة موافقتك على هذه الشروط الخصوصية. إذا كنت لا توافق على الالتزام أو لا تستطيع الالتزام بأي من شروط المسابقة، فيرجى عدم المتابعة. حيث سيؤدي عدم قبولك شروط المسابقة هذه وقبولها بالكامل إلى استبعاد مشاركتك في المسابقة.

وتخضع المسابقة لشروط المسابقة، ، ومن خلال دخولك في المسابقة، فإنك تقر بأنك قد قرأت وفهمت ووافق دون قيد أو شرط على الالتزام بشروط هذه المسابقة. فالجدير بالذكر أن قرارات الشركة بشأن جميع المسائل المتعلقة بالمسابقة هي قرارات نهائية وملزمة من جميع النواحي. وعليه تقر بأن مشاركتك في المسابقة تتم على أساس طوعي .

كما تحكم سياسة الخصوصية جميع عمليات الجمع والتخزين والاستخدام والنقل والاحتفاظ والافصاح عن أي معلومات شخصية (المحددة أدناه) أو أي معلومات أخرى كما هو مفصل في سياسة الخصوصية، بما في ذلك على سبيل المثال لا الحصر، المعلومات المتعلقة بمشاركتك. في المسابقة أو أي معلومات جمعتها الشركة بموجب هذه المسابقة (إن وجدت) (يشار إليها فيما يلي بشكل جماعي باسم "البيانات").

فمن خلال المشاركة في المسابقة، يمكنك القيام بما يلي:

1. تمنح الشركة وموظفيها والممثلين المخولين والوكلاء والمتنازل لهم (يشار إليهم فيما يلي بشكل جماعي باسم "كيانات الشركة") الإذن بجمع واستخدام وتخزين ونقل والافصاح عن بياناتك الشخصية.
2. تقر بأنه يتعين على كيانات الشركة جمع البيانات فيما يتعلق بمشاركتك في المسابقة. فرفضك تزويد كيانات الشركة بمعلومات معينة والموافقة على جمع بياناتك واستخدامها وتخزينها ونقلها والكشف عنها أن يمنح الشركة الحق في استبعادك من المشاركة في المسابقة.
3. تأذن للشركة و/أو لكيانات الشركة بالاتصال بك باستخدام الهاتف والبريد الإلكتروني وأنظمة الاتصال الهاتفي التلقائي وأنظمة الرسائل النصية التلقائية، بما في ذلك على سبيل المثال لا الحصر الردود الصوتية التفاعلية والخطوط الساخنة. من خلال المشاركة في المسابقة، فإنك تقر أيضًا أنك المالك أو المستخدم المعتاد لرقم الهاتف المحمول/رقم واتساب الذي قمت بمشاركته مع الشركة كجزء من مشاركتك/المستخدم لمشاركة مشاركتك في المسابقة.
4. يتمتع واتساب وإنستغرام وفيسبوك أو أي من شركاء الاتصالات أو شركاء وسائل التواصل الاجتماعي بإمكانية الوصول، من بين أمور أخرى، إلى البيانات الوصفية المتعلقة بالمراسلات (بما في ذلك المشاركة) التي أرسلتها إلى الشركة ولكن قد لا يتمكنون من عرض محتويات مثل هذه المراسلات. كما يمكن أن يختلف مدى قدرة هؤلاء الشركاء على الوصول إلى محتوى المراسلات. لذا يجب عليك مراجعة سياسات الخصوصية الخاصة بهذه الجهات الخارجية قبل المشاركة. حيث لا تتحمل الشركة المسؤولية عن استخدام بياناتك من قبل هذه الجهات.
5. توافق بموجبه على كل ما سبق.

وفي حال نشأ أي تعارض بين سياسة الخصوصية وهذه الشروط والأحكام، تسود هذه الشروط والأحكام في حال نشأ أي تعارض من هذا القبيل.

تبدأ المسابقة من تاريخ الذي تعلن عنه الشركة وتنتهي كما هو مذكور في هذا الإعلان  (يشار إليها فيما يلي باسم "فترة المسابقة"). ويحق للشركة إجراء تغييرات على فترة المسابقة. وستبلغ الشركة بأي تغيير في فترة المسابقة عبر القناة أو صفحات وسائل التواصل الاجتماعي أو أي وسيلة اتصال أخرى قد تراها الشركة مناسبة. ولتجنب الشك، تجدر الإشارة إلى ضرورة تقديم المشاركات خلال فترة المسابقة.  . ومع ذلك، قد يتم اختيار الفائزين ويمكن توفير الجوائز بعد نهاية فترة المسابقة.

توافق وتقر على حقيقة أنك لست ملزمًا بدفع أي مبالغ للشركة مقابل المشاركة في المسابقة. ومع ذلك، فإنك تفهم وتقر بأنه يجوز لمقدم خدمة الاتصالات أو مقدم خدمة الإنترنت الخاص قد يفرض رسومًا قياسية معينة وفقًا للأسعار المعمول بها بالإضافة إلى رسوم مميزة عليك مقابل استخدام خدماته المطبقة فيما يتعلق بمشاركتك في المسابقة، والتي سيتم تحملها بواسطتك فقط. توصي الشركة بمراجعة مزود خدمة الاتصالات/الإنترنت الخاص بك لمعرفة جدول الرسوم التي قد يتم تطبيقها.

(1) أهلية المشاركين

للمشاركة في المسابقة، يجب على المشارك (المشاركين) الالتزام بما يلي:

1. يجب أن يكون المشارك (المشاركون) من الأفراد المقيمين في الإقليم، وليسوا مواطنين في أي دولة خاضعة للعقوبات (حيث تعني الدولة الخاضعة للعقوبات الاتحاد الروسي، وجمهورية دونيتسك الشعبية، وجمهورية لوهانسك الشعبية، وبيلاروسيا، وبورما (ميانمار)، وشبه جزيرة القرم، وكوبا، جمهورية الكونغو الديمقراطية، وإيران، وساحل العاج، وليبيريا، وكوريا الشمالية، والصومال، والسودان، وسوريا، وزيمبابوي وأي دولة أخرى تطبق عليها حكومة الولايات المتحدة أو قد تستمر في تطبيق برامج العقوبات الاقتصادية الأمريكية عليها وفقًا لما قد يتم تحديثه من وقت لآخر).
2. المشارك (المشاركون) انهم ليسوا مدرجين في أي قائمة للمواطنين المحددين بشكل خاص والأشخاص المحظورين الصادرة عن مكتب مراقبة الأصول الأجنبية التابع لوزارة الخزانة الأمريكية:
3. يجب أن يكون عمر المشارك (المشاركين) 18 (ثمانية عشر) عامًا أو أكثر ويجب أن يكون قد بلغ سن الرشد في الإقليم على الأقل في تاريخ بدء فترة المسابقة.
4. يجب ألا يكون لدى المشارك (المشتركين) أي إدانة جنائية أو ترتيب أو عقد يمنع المشارك (المشاركين) من المشاركة في المسابقة . يجب أن يكون المشارك (المشاركون) مؤهلاً قانونًا، وفقًا لقوانين الولاية القضائية التي يخضع لها (المشاركون)، لإبرام عقد.
5. لا ينبغي أن يكون المشارك و/أو أفراد أسرته المباشرين موظفًا (دائمًا أو متعاقدًا) و/أو مديرًا في: (1) الشركة؛ (2) كيانات الشركة؛ و(3) أي وكالات إعلان وترويج، وشركاء المسابقة، والموزعين، وموردي الجوائز، بما في ذلك كل من الشركات الأم والشركات التابعة والشركات التابعة لها و/أو الكيانات المرتبطة بالترويج للمسابقة  (يُشار إليهم فيما يلي بشكل جماعي باسم "الرعاة") إن أمكن.
6. يحق للشركة التحقق من أهلية جميع المشاركين.
7. يؤدي عدم امتثال المشارك (المشاركين) لجميع شروط المسابقة المنصوص عليها في الشروط والأحكام أو كما تحددها الشركة من وقت لآخر سيجعل مشاركة هذا المشارك في المسابقة لاغية وباطلة.

(2) آلية المشاركة:

1. خلال فترة المسابقة، يتم طرح سؤال أو أكثر يتعلق بفيلم "مملكة كوكب القردة" ("يُشار إليه فيما يلي باسم الفيلم") مع ثلاثة خيارات - خياران غير صحيحين وخيار واحد صحيح ((كل منها "سؤال" ومجتمعة "أسئلة")") سيتم نشرها من قبل الشركة على أي من صفحات وسائل التواصل الاجتماعي التالية أو جميعها:صفحة ستار بلس الشرق الأوسط على الفيسبوك؛ صفحة ستار بلس الشرق الأوسط على الانستغرام؛صفحة آسيانيت الشرق الأوسط على الفيسبوك؛ و/أو صفحة آسيانيت الشرق الأوسط على الانستغرام ؛ (ويُقصد بمصطلح "صفحة وسائل التواصل الاجتماعي"). يجب أن يكون محتوى الأسئلة وشكلها وتكرارها وتوقيتها وفقًا لتقدير الشركة وحدها.
2. للمشاركة في المسابقة، يجب على المشاركين مشاهدة القناة أو متابعة صفحة وسائل التواصل الاجتماعي خلال فترة المسابقة ومشاركة الإجابة الصحيحة على الأسئلة مع الشركة عبر تطبيق الواتساب ، في موعد أقصاه الوقت المنصوص عليه في المراسلات / الإعلانات الصادرة فيما يتعلق بالمسابقة ("التوقيت النهائي"). "الوقت") . من أجل الوضوح، يجب أن يكون حساب الواتساب حسابًا شخصيًا للمشارك (المشاركين) وليس حسابًا تجاريًا و/أو ترويجيًا و/أو أي نوع آخر من الحسابات. ، يتعين على المشاركين (المشاركين) إرسال الإجابة الصحيحة عبر تطبيق الواتساب إلى الشركة على الرقم "3246 188 52 00971" أو على رقم آخر قد ترسله الشركة من وقت لآخر الوقت (يُشار إليه فيما يلي باسم " "الدخول" "). أي إدخالات يتم إرسالها عبر أي وسيلة (طرق) اتصال أخرى، بما في ذلك على سبيل المثال لا الحصر، إلى أي أرقام الواتساب أخرى غير رقم الواتساب الموضح أعلاه أو بتنسيق آخر غير ما هو منصوص عليه أعلاه، لن تعتبر مشاركة صالحة للمسابقة. .
3. لا يُسمح سوى بالمشاركة الأولى للمشارك في كل سؤال، ويتم أخذها في الاعتبار لغرض القائمة المختصرة.. من أجل الوضوح، إذا أرسل أحد المشاركين عدة مشاركات كإجابات على أي سؤال واحد، فلن يُنظر سوى في المشاركة الأولى فحسب، في حين تُعد أي مشاركة (مشاركات) لاحقة لاغية وباطلة. علاوة على ذلك، فإن أي إدخال يتم إرساله بعد الأوقات النهائية للسؤال لن يعتبر إدخالاً صالحًا.

5. يجب على المشارك (المشاركين) المشاركة في المسابقة بالأصالة عن أنفسهم فقط ولن تُقبل المشاركة (المشاركات) عن طريق الوكلاء.
6. تُعد المشاركات المستلمة قبل بدء فترة المسابقة أو انتهائها باطلة. كما يكون تحديد الشركة لتاريخ ووقت استلام المشاركات نهائيًا وملزمًا لجميع المشاركين. وستؤدي أي مشاركات غير كاملة أو غير مقروءة إلى الحرمان من المشاركة في المسابقة واستلام أي جائزة.
7. لن تتحمل الشركة مسؤولية أي مشاركة يتم تقديمها ولكن لا يتم استلامها أو قيدها لأي سبب كان. دون الحد من عمومية ما سبق، لن تتحمل الشركة المسؤولية بأي شكل من الأشكال عن (أ) أي فعل أو تقصير من جانب أي من مقدمي الخدمات من الجهات الخارجية، ويشمل ذلك عدم استلام/ تسليم أي رسائل، بما في ذلك على سبيل المثال لا الحصر؛ توقف تطبيق انستجرام وتوقف تطبيق فيسبوك عن العمل ومشكلات الشبكة (بما في ذلك الشبكة غير الواضحة) وتعطل الآلات وتعطل الشبكة و/ أو تكاليف الإنترنت/ الشبكة التي يفرضها مشغل الاتصالات/ الجوال/ الشبكة/ مقدم الخدمات من الجهات الخارجية، وما إلى ذلك التي قد يتكبدها المشارك أثناء المشاركة في المسابقة (ب) المشاركات المفقودة أو غير الصالحة أو الموجهة بشكل خاطئ أو المتأخرة أو غير المكتملة أو غير المفهومة أو بسبب معلومات الدخول غير الدقيقة، سواء أكان ذلك بسبب المشاركين أو بسبب أي أخطاء فنية أو بشرية من أي نوع كانت قد تحدث أثناء معالجة هذه المشاركات؛ و/ أو (ب) أي خطأ في التشغيل أو النقل أو السرقة أو التدمير أو الوصول غير المصرح به أو تغيير المشاركات أو الأعطال التقنية في الشبكة أو الحاسوب أو الأجهزة أو البرامج من أي نوع، أو النقل غير الدقيق أو عدم تلقي أي معلومات دخول بسبب مشاكل فنية أو زيادة عدد الزيارات على الإنترنت أو في أي موقع اٍلكتروني، مما يؤدي إلى عدم تلقي الشركة المشاركة. لا يشكل أي استلام تلقائي للتأكيد دليلاً على الاستلام الفعلي للمشاركة.
8. سيتم النظر في المشاركات المؤهلة فقط التي تم استلامها من المشاركين المؤهلين، خلال فترة المسابقة. يقر كل مشارك بأن المشاركة موثوقة ولم يتم تزييفها لأغراض المسابقة.
9. يجب على المشتركين التأكد من أن المشاركة أصلية ولائقة وليست غير أخلاقية أو فاحشة أو تشهيرية أو مهينة أو مسيئة أو مهينة أو غير حساسة أو تشهيرية أو تجدفية لأي شخص ولا تنتهك حق الخصوصية لأي شخص . يوافق المشتركين بموجب هذا ويؤكد أن المشاركة تتوافق مع جميع القوانين المعمول بها في الإقليم ويوافق على إبقاء الشركة و/أو كيانات الشركة و/أو الراعي معفاة من أي مطالبة بهذا الشأن. يؤدي عدم الالتزام بهذا الشرط إلى الاستبعاد الفوري للمشتركين من المسابقة.
10. يجب المشتركين التأكد من أن المشاركة يجب أن تكون خالية من أي فيروسات/أحصنة طروادة/برامج تجسس/برامج ضارة أو أي برنامج من هذا القبيل قد يضر بأجهزة الكمبيوتر/النظام/الخوادم الخاصة بالمستلم وما إلى ذلك أو يحتوي على أي روابط تهدف إلى الإضرار و / أو توفير الوصول غير المصرح به إلى جهاز الكمبيوتر الخاص بالمستلم والبيانات الموجودة فيه.
11. سيكون بعض المشاركين المختارين مؤهلين للحصول على الجائزة (كما هو محدد أدناه) وفقًا لقسم عملية الاختيار والمكافأة أدناه.

(3) عملية الاختيار والمكافأة: 

1. يجب على الشركة، في غضون خمسة عشر (15) يومًا بعد انتهاء فترة المسابقة أو كما تقرر الشركة بخلاف ذلك وفقًا لتقديرها الخاص، أن تضع قائمة مختصرة عشوائيًا بما لا يزيد عن عشرة (10) مشاركين (باستخدام أداة عشوائية لاختيار الفائزين من بين من بين جميع المشاركين الذين أجابوا على الأسئلة بشكل صحيح والذين سيكونون مؤهلين للحصول على الجائزة (يُشار إلى كل منهم بـ "الفائز" وبشكل جماعي بـ "الفائزين") وفقًا لشروط المسابقة. يجب على هؤلاء الفائزين استيفاء جميع المتطلبات المنصوص عليها في هذه الشروط والأحكام بما في ذلك تقديم مستندات صالحة (كما هو مطلوب من قبل الشركة) بما يرضي الشركة.
2. سيحصل كل من الفائزين العشرة (العشرة) على فرصة للفوز بتذكرتي سينما لعرض الفيلم ("الجائزة"). يجوز تقديم الجائزة إما عن طريق الشركة أو أي كيان آخر تعينه الشركة. قد تكون الجائزة في شكل تذاكر مادية أو بريد دعوة أو رموز رقمية وفقًا لتقدير الشركة وحدها. في حالة اختيار الشركة، وفقًا لتقديرها الخاص، إصدار تذاكر مادية كجائزة، سيُطلب من الفائزين تحصيل هذه التذاكر المادية في التاريخ ومن هذا الموقع كما أبلغت الشركة عنه والمذكور في رسالة الشركة إلى الفائزين. أنت توافق وتفهم أن الشركة ستحدد، وفقًا لتقديرها الخاص، جميع جوانب الجائزة، بما في ذلك التاريخ واختيار المقاعد وطبيعة العرض والمسرح لعرض الفيلم المتوافق مع التذاكر / الدعوات الصادرة كجزء من الجائزة. الجائزة ولا يجوز لك إثارة أي اعتراض فيما يتعلق بها.
3. سيتم الاتصال بالفائزين من خلال تفاصيل الاتصال المقدمة مع المشاركة. قد يُطلب من الفائزين ومرافقيهم تنفيذ مستندات إضافية كما هو مطلوب من قبل الشركة كشرط مسبق للمطالبة بالجائزة. في حالة عدم تمكن الفائز من التحقق من تفاصيل الأهلية، سيتم استبعاد الفائز المذكور من المسابقة، وفقًا لتقدير الشركة وحدها ولن يكون مؤهلاً للحصول على الجائزة. يوافق كل فائز، بما في ذلك بالنيابة عن الرفيق (المحدد أدناه) ويقر أيضًا بأن الجائزة قد تخضع لشروط وأحكام إضافية قد يفرضها مقدمو الطرف الثالث، من وقت لآخر والفائزون، بما في ذلك و بالنيابة عن الرفيق، الموافقة على الالتزام بهذه الشروط والأحكام، دون الرجوع إلى الشركة. بغض النظر عن أي شيء يتعارض مع ذلك وإلى الحد الأقصى المسموح به بموجب القانون المعمول به، لا تقدم الشركة و/أو كيانات الشركة أي إقرار أو ضمانات، سواء كانت صريحة أو ضمنية، فيما يتعلق بالمسابقة و/أو الجائزة بما في ذلك ما يتعلق بملاءمة المسابقة أو قابليتها للتسويق. جائزة.
4. ستعلن الشركة عن نتائج المسابقة والفائزين في غضون 15 يومًا بعد انتهاء الفترة التي يجوز فيها تقديم المشاركات أو حسبما تقرره الشركة وفقًا لتقديرها الخاص. في حالة تأجيل الإعلان عن الفائزين لأي سبب من الأسباب، لن تتحمل الشركة المسؤولية ولن يكون هناك إعلان عن الفائزين في أي منتدى عام أو غير ذلك. في هذه الحالة، ترى الشركة أن أيًا من المشاركين غير مؤهل ليتم اختياره كفائز، فيجوز للشركة ممارسة تقديرها بعدم اختيار أي فائز. لا يعتبر أي تأخير أو فشل في تسليم الجائزة لأسباب خارجة عن سيطرة الشركة انتهاكًا لهذه الشروط والأحكام من قبل الشركة/كيانات الشركة.
5. لن تكون الشركة مسؤولة إذا (1) لم يكن الفائزون متاحًا في تفاصيل الاتصال المقدمة منهم في المشاركات؛ و/أو (2) الفشل في تحصيل الجائزة وفقًا للمراسلات الواردة من الشركة ونتيجة لذلك يفقد هذا الفائز الفائزون فرصته في استلام الجوائز. يجب على الشركة أن تقوم بمحاولة واحدة (1) فقط للوصول إلى الفائزين. في حالة عدم عودتهم خلال الجدول الزمني المحدد في اتصالات الشركة مع هذا الفائز، سيتم إبطال الاختيار ولن تكون الشركة مسؤولة تجاه هذا الفائزين بأي شكل من الأشكال. ولتجنب الشك، تم التوضيح أنه إذا تم إبطال اختيار الفائز للأسباب المبينة أعلاه، يحق للشركة (ولكن ليس الالتزام) اختيار المشارك المؤهل التالي باعتباره الفائز.
6. يجب أن يكون الفائزون متاحًا كما هو مطلوب من قبل الشركة لمشاركة إدخالاتهم (مشاركاتهم) التي قد تحددها الشركة من وقت لآخر (وفقًا لتقدير الشركة وحدها). لن تكون الشركة مسؤولة تجاه أي فائز و/أو مرافقه عن أي خسارة/ ضرر يلحق بشخصه أو ممتلكاته نتيجة/تكبدها أثناء استلام الفائزين و/أو مرافقيهم للجائزة ويجب على الفائز (الفائزين) ومرافقيهم، مجتمعين ومنفردين، تعويض الشركة عن أي خسارة تتكبدها نتيجة لذلك.
7. إذا شارك أحد المشاركين في أي سلوك تعتقد الشركة وفقًا لتقديرها الخاص أنه يضر بروح المسابقة، فسيؤدي ذلك إلى استبعاد هذا المشارك من المسابقة واستلام أي جائزة.
8. تكون جميع القرارات التي تتخذها الشركة نهائية وملزمة ولا تخضع لأي استئناف من أي نوع كانت. تُفسر المشاركة في المسابقة على أنها تعني أن المشارك (المشاركين) قد تنازل عن حقه في الاعتراض على أي قرار (قرارات) اتخذتها الشركة، إلى الحد الأقصى الذي يسمح به القانون.
9. تحتفظ الشركة بالحق في تغيير الجائزة أو سحبها في أي وقت (أ) إذا لم يلتزم الفائز المختار بأي من شروط المسابقة و/أو القوانين السارية؛ أو (ب) البقاء ملتزمًا بالقوانين السارية.
10. إلى الحد الأقصى المسموح به بموجب القوانين السارية، (أ) لا تتحمل كيانات الشركة والجهات الراعية أي مسؤولية ولن تتحمل المسؤولية عن أي أضرار أو خسائر أو إصابات أو إزعاج أو أي التزامات أخرى من أي نوع كانت تنشأ فيما يتعلق مع استيفاء أي جائزة؛ و(ب) يُعفي المشارك بموجبه الشركة وكيانات الشركة والراعي من جميع المسؤوليات الناشئة عن أي إصابات شخصية أو خسارة أو ضرر للممتلكات وإساءة استخدام الجائزة المقدمة بموجب هذه المسابقة، سواء بشكل مباشر أو غير مباشر، بسبب قبول المسابقة أو حيازتها أو المشاركة فيها، بما في ذلك أثناء شحن/ استلام الجائزة إلى الفائز (إن أمكن).
11. اٍذا لم يقدم المشارك (المشاركين) و/أو الفائز أي وثائق تطلبها الشركة بغرض التحقق من الامتثال لهذه الشروط والأحكام، فسيتم استبعاد هذا المشارك (المشاركين) و/ أو الفائز دون أي مسؤولية تجاه الشركة.
12. الجائزة غير قابلة للاسترداد وغير قابلة للتحويل وغير قابلة للاستبدال. لغرض التوضيح، لن يتم منح أي جائزة نقدية معادلة أو بديلة للفائز ولا يمكن للفائز استبدال الجائزة بهدية ذات قيمة معادلة و/ أو تصفية الجائزة في شكل نقد أو أموال أو أي طبيعة أخرى من المصالح . علاوة على ذلك، فإن الجائزة التي تم الفوز بها هي جائزة شخصية للفائز ولا يمكن للفائز تحويل الجائزة إلى أي شخص (أشخاص) آخر . باستثناء مشاركة الجائزة مع رفيق من اختيارهم ("الرفيق") وفقًا لشروط المسابقة.

(5) شروط إضافية

1-يُطلب من الفائز أيضًا الامتثال للمتطلبات الإضافية التي قد تنشرها الشركة و / أو تعرضها و / أو تبلغ بها من وقت لآخر.

6-يلتزم المشاركون و / أو الفائز في جميع الأوقات بالتصرف وفقًا للعادات والتقاليد الاجتماعية والأخلاق العامة، ولن يرتكبوا أي فعل من شأنه أن يُسيء إلى سمعة كيانات الشركة أو يُسيء إلى أي من هذه الأطراف..

11. يوافق المشاركون على عدم استضافة أو عرض أو تحميل أو تعديل أو نشر أو نقل أو تحديث أو مشاركة أي معلومات تخص شخص آخر ولا يملك المستخدم أي حق فيها، أو ينتهك أي براءة اختراع أو علامة تجارية أو حقوق الطبع والنشر أو أي ملكية أخرى الحقوق، أو انتحال شخصية شخص آخر، أو انتهاك خصوصية شخص آخر، أو الكراهية، أو المرفوضة عنصريًا، أو عرقيًا، أو الاستخفاف و/أو انتهاك أي قانون ساري المفعول في الوقت الحالي،

17-من خلال المشاركة في المسابقة، يُفسر ذلك بأن المشاركين و / أو الفائز قد تنازلوا عن حقهم في رفع أي نزاع فيما يتعلق بالمسابقة و / أو الجائزة و / أو أي قرار للشركة، بأي طريقة كانت، إلى أقصى حد يسمح به القانون الساري.

18-تخضع المسابقة للقوانين السارية في دولة الإمارات العربية المتحدة ويتم تفسيرها وفقًا لها. وتخضع جميع الأمور المتعلقة بالمسابقة للاختصاص القضائي الحصري لمحاكم دبي.

KINGDOM OF THE PLANET OF THE APES MOVIE CONTEST 

TERMS AND CONDITIONS

 The following terms and conditions (“Terms and Conditions”) govern the entire process for participation in the “Kingdom of the Planet of the Apes Movie Contest” (“Contest”) and shall be binding on each participant (“Participant”, “Your” and/or  “You”) residing in the United Arab Emirates (UAE) (the “Territory”) who voluntarily desire to participate in the Contest hosted by Star Asianet Middle East FZ LLC together with its affiliates, associates, agencies etc., as the case may be (collectively referred to as “Company”) and sets out inter alia the terms of participation in the Contest and selection of the Winner(s) of the Contest.

Your act of participating in the Contest shall be deemed to be your absolute agreement to the rules and regulations, these Terms and Conditions and privacy policy available at https://www.disneystar.com/legal-terms-policies/terms/contest-terms-conditions/wish-movie-contest-same-privacy-policy/ (“Privacy Policy”) as prescribed by Company from time to time (hereinafter collectively referred to as the “Contest Terms”). Upon a Participant sending an Entry to Company, Company may, at its sole discretion, share a link of these Contest Terms. Your continuing participation in the Contest will be deemed as Your acceptance to these Contest Terms. If you do not agree to be bound or cannot comply with any of the Contest Terms, please do not continue. Your failure to comply with and accept these Contest Terms in entirety will disqualify your participation in the Contest.

The Contest shall be governed by the Contest Terms and by entering the Contest, You acknowledge that You have read and understood, and unconditionally agree to comply with and abide by these Contest Terms. It is clarified that Company’s decisions on all matters relating to the Contest shall be final and binding in all respects. You represent that Your participation in the Contest is on a voluntary basis. 

The Privacy Policy shall govern all aspects of collection, storage, usage, transfer, retention, disclosure of any Personal Information and/or any other information as detailed in the Privacy Policy, including but not limited to, information in relation to Your participation in the Contest, any information gathered under, or pursuant to this Contest by Company (if any) (collectively, “Data”).

By participating in the Contest:

(i) You are authorizing Company and their employees, authorised representatives, agents, assigns (collectively “Company Entities”) to collect, use, store, transfer and disclosure Your Data;
(ii) You acknowledge that Data is required to be collected by Company Entities in relation to Your participation in the Contest. Your refusal to provide Company Entities certain information and consent to collect, use store, transfer and disclose Your Data would entitle Company to disqualify You from participation in the Contest;
(iii)You are authorising Company and/or Company Entities to contact You using telephone, email, automatic telephone dialling systems, automatic texting systems and artificial or pre-recorded messages, including without limitation IVR’s and hotlines. By participating in the Contest, You also represent that You are the owner or customary user of the mobile phone number/ WhatsApp number which You have shared with Company as part of Your Entry/ used to share Your Entry for the Contest.
(iv) WhatsApp, Instagram, Facebook and/or any communications partners and/or social media partners will have access inter alia to metadata relating to communications (including the Entry) sent by You to Company but may not be able to view the contents of such communications. The extent to which such partners can access the content of communications will vary. You should review the privacy policies of such third parties before participating. Company is not responsible for the use of Your Data by such third parties.
(v) You hereby consent to all of the foregoing.

To the extent of any conflict between the Privacy Policy and these Terms and Conditions, these Terms and Conditions will prevail to the extent of any such conflict.

The Contest shall commence from the date as announced by Company and shall conclude as mentioned in such announcement (“Contest Period”). For the avoidance of doubt, it is clarified that the Entries must be submitted within the Contest Period. However, the Winners may be selected and the Prizes may be made available after the end of the Contest Period.

You agree and acknowledge that You are not required to make any payments to Company for participating in the Contest. However, You understand and acknowledge that Your telecom service provider/ internet service provider may impose certain standard charges as per applicable rates as well as premium charges on You for use of their applicable services in relation to Your participation in the Contest, which shall be borne solely by You. Company recommends You check with Your telecom/ internet service provider for schedule of charges that may apply.

(I) Participants’ Eligibility

To participate in the Contest the Participant(s) must comply with the below:

1. The Participant(s) must be individual residents of the Territory, who are not citizens of any sanctioned country (where sanctioned country means Russian Federation, Donetsk People’s Republic, Luhansk People’s Republic, Belarus, Burma (Myanmar), Crimea, Cuba, Democratic Republic of Congo, Iran, Ivory Coast, Liberia, North Korea, Somalia, Sudan, Syria, Zimbabwe and any other country against whom the U.S. economic sanctions programs are or may be maintained by the U.S. Government, as may be updated from time-to-time).

2. The Participant(s) are not on any list of Specially Designated Nationals and Blocked Persons issued by the US Treasury Department’s Office of Foreign Assets Control:

3. The Participant(s) must be aged 18 (eighteen) years or above and at minimum should have attained the age of majority as per laws of the Territory at the start date of the Contest Period.

4. The Participant(s) should not have any criminal conviction or an arrangement or a contract that prevents the Participant(s) from participating in the Contest. The Participant(s) should be legally eligible, as per the laws of the jurisdiction to which the Participant(s) is(are) subject, to enter into a contract.

5. The Participant, and/or their immediate family members, should not be an employee (permanent or contracted) and/or director, of: (i) Company; (ii) Company Entities; and (iii) any advertising and promotion agencies, contest partners, the distributors, suppliers of prizes, including each of their parent, subsidiary and affiliated companies and/or entities connected with the promotion of the Contest (collectively, the “Sponsor”).

6. Company reserves the right to verify the eligibility of all Participants.

7. Non-conformance by the Participant(s) with any and all of the Contest Terms herein or as set by Company from time to time will make such Participant’s participation in the Contest null and void.

(II) Participation Mechanism:

1. During the Contest Period, one or more questions related to the movie “Kingdom of the Planet of the Apes” (“Movie”) with three options – two incorrect options and one correct option (each a “Question” and collectively, “Questions”) shall be posted by Company on any or all of the following social media pages: Star Plus Middle East Facebook page; Star Plus Middle East Instagram page; Asianet Middle East Facebook page; and/or Asianet Middle East Instagram page (together “Social Media Page”). The content, format, frequency and timing of the Questions shall be at Company’s sole discretion.

2. To enter the Contest, Participants must follow the Social Media Page and share the correct answer to the Questions with Company via WhatsApp, no later than the time as stipulated in the communications/ announcements issued in relation to the Contest ("Cut-Off Time”). For the sake of clarity, such WhatsApp account shall be a personal account of the Participant(s) and not the business and/or promotional and/or any other type of account. To send in the answers to the Questions, Participant(s) are required to direct message the correct answer on WhatsApp to Company on “00971 52 188 3246” and/or on such other number as may be communicated by Company from time to time (“Entry”). Any entries sent via any other mode(s) of communication, including without limitation, to any other WhatsApp numbers other than the WhatsApp number set out above or in a format other than as prescribed above shall not be considered as a valid entry for the Contest.

3. Only the first Entry for the applicable Question by a Participant shall be allowed and considered for the purpose of shortlisting. For the sake of clarity, if a Participant has submitted multiple Entries for the same Question, only the first Entry for that Question shall be considered, and any subsequent Entry(ies) shall be considered null and void. Further, any entry sent after the Cut-Off Times for a Question will not be considered a valid Entry.

4. Each Entry should provide all required information requested from the Participant(s). If the same is not complied with, then the Entry will not be considered for the Contest and will be disqualified. All information submitted by a Participant must be accurate and complete and are subject to the provision of proof(s) by such Participant, upon request by Company. It is clarified that Participants who have already provided the required information in a previous Entry shall be required to provide the required information again in every fresh Entry that they submit.

5. Participant(s) must enter the Contest on their own behalf only and Entry(ies) by proxies shall not be accepted.

6. The Entries received before the commencement and/or after the expiration of the Contest Period shall be void. Company’s determination of the date and time of receipt of Entries shall be final and binding on all Participants. Any incomplete and/or illegible Entries will result in disqualification from participation in the Contest and the receipt of any Prize.

7. Company shall not be responsible for any Entry submitted but not received or recorded due to any reason whatsoever. Without limiting the generality of the foregoing, Company shall not be responsible and/or liable in any manner whatsoever for (a) any acts or omission of any third-party service providers, including failure in receipt of/ delivery of any messages, including without limitation, WhatsApp downtime, network problems (including unclear network), breakdown of machinery, disruption in the network and/or the internet /network costs charged by the telecom/mobile/network operator etc. that the Participant may incur while participating in the Contest; (b) lost, invalid, misdirected, late, incomplete or unintelligible entries, or for inaccurate entry information, whether caused by the Participant(s) or by any technical or human errors of any nature whatsoever that may occur in the processing of such Entries; and/or (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of entries, or for technical, network, computer, hardware or software malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the internet or at any website, that results in an Entry not being received by Company. Any automated receipt of confirmation does not constitute proof of actual receipt of the Entry

8. Only eligible Entries received from eligible Participants, during the Contest Period, will be considered for the Contest. Each Participant represents that the Entry is authentic and not fabricated for the purposes of the Contest.

9. The Participant(s) shall ensure that the Entry is original, decent and is not immoral, obscene, defamatory, derogatory, abusive, offensive, insensitive, libellous or blasphemous to any person nor does it violate the right to privacy of any person. The Participant(s) hereby agrees and confirms that the Entry is in compliance with all applicable laws of the Territory and agrees to keep Company, Company Entities and/or Sponsor indemnified from any claim thereto. non-compliance with this clause shall lead to the immediate disqualification of the Participant(s) from the Contest.

10. The Participant(s) shall ensure that the Entry shall be free of any virus/trojans/spyware/malware or any such program which may harm the recipient’s computers/ system/servers etc. or contain any links which are intended to harm and/or provide unauthorized access to the recipient’s computer and the data therein.

11. Certain selected Participants will be eligible to receive the Prize (as defined below) in accordance with the Selection Process and Gratification section below.

(III) Selection Process and Gratification:

1. Company shall within fifteen (15) days after the expiry of the Contest Period or as otherwise decided by Company in its sole discretion, randomly shortlist no more than ten (10) Participants (using a randomiser to select the winner(s) from among all Participants who have answered the Question(s) correctly) who will be eligible to receive the Prize (each a “Winner” and collectively “Winners”) as per the Contest Terms. Such Winners shall be required to fulfil all of the requirements set out in these Terms and Conditions including submitting of valid documents (as required by Company) to the satisfaction of Company.

2. Each of the 10 (ten) Winners will stand a chance to win 2 (two) movie tickets for screening of the Movie (“Prize”). Prize may be provided either by Company or any other entity designated by Company. The Prize may be in the form of physical tickets, invitation mail or digital codes at the sole discretion of Company. In case, Company, at its sole discretion elects to issue physical tickets as Prize, the Winners shall be required to collect such physical tickets on such date and from such location as communicated by Company and stated in the communication by Company to Winners. You agree and understand that Company shall, at its sole discretion, determine the all aspects of the Prize, including, the date, choice of seats, nature of the screening, theatre for screening of the Movie corresponding to the tickets/ invitations issued as part of the Prize and You will not raise any objection in relation to the same.

3. The Winners will be contacted through the contact details provided with the Entry. Winners and their Companion may be required to execute additional documents as required by Company as a condition precedent to claim the Prize. In case a Winner is unable to verify the eligibility details, the said Winner shall be disqualified from the Contest, at the sole discretion of Company and shall not be eligible to receive the Prize. Each Winner, including for and on behalf of the Companion (defined below) further agrees and acknowledges that the Prize may be subject to additional terms and conditions as may be imposed by third party providers, from time to time and the Winners, including for and on behalf of the Companion, agree to adhere to such terms and conditions, without any recourse to Company. Notwithstanding anything to the contrary and to the maximum extent permitted under applicable law, Company and/or Company Entities make no representation and warranties, whether express or implied, with respect to the Contest and/or Prize including in relation to fitness or merchantability of the Prize.

4. The results of the Contest and the Winners will be announced by the Company within 15 days after the expiry of the period in which Entries may be submitted or as otherwise decided by the Company in its sole discretion. In the event, such announcement of Winner(s) is postponed for any reason whatsoever, the Company will not be held responsible for and there shall be no announcement of Winners on any public forum or otherwise. In the event, Company is of the opinion none of the Participants are eligible to be selected as a Winner, then Company may exercise its discretion not to select any Winner. Any delay or failure in delivery of the Prize for reasons not in the control of Company, shall not be deemed as breach of these Terms and Conditions by Company/ Company Entities.

5. Company shall not be responsible if (i) the Winner(s) are not available at the contact details provided by them in the Entries; and/or (ii) fails to collect the Prize in accordance with the communication from Company and as a result of which such Winner(s) loses their chance to receive the Prizes. Company shall make only one (1) attempt to reach the Winner(s). In case they do not revert within the timeline specified in Company’s communication to such Winner, the selection shall be invalidated and Company shall not be liable to such Winner(s) in any manner whatsoever. For the avoidance of doubt, it is clarified that if a Winner’s selection is invalidated due to reasons set out hereinabove, Company shall have the right (but not the obligation) to select the next eligible Participant as the Winner.

6. The Winner(s) shall be required to be available as required by Company to share their Entry(ies) that Company may specify from time to time (at company’s sole discretion). Company shall not be liable to any Winner and/or their Companion for any loss/ damage to their person or property caused/incurred during the Winners’ and/or their Companion’s receipt of the Prize and the Winner(s) and their respective Companion(s) shall, jointly and severally, keep Company indemnified for any loss suffered as a result of the same.

7. If any Participant engages in any behaviour that Company in its sole discretion believes to be prejudicial to the spirit of the Contest, it will result in such Participant’s disqualification from the Contest and the receipt of any Prize.

8. All decisions taken by Company shall be final and binding and shall not be subject to any appeal of any nature whatsoever. Entry in the Contest shall be construed to mean that the Participant(s) has(ve) waived their right to dispute any decision(s) made by Company, to the maximum extent permissible by law.

9. Company reserves the right to change or withdraw the Prize at any tine (i) should the selected Winner(s)/ their Companion fail to comply with any of the Contest Terms and/or applicable laws; or (ii) to remain in compliance with applicable laws.

10. To the maximum extent permissible under applicable laws, (a) Company, Company Entities and Sponsor assume no responsibility and shall not be held liable for any damages, losses, injuries, inconvenience, or any other liabilities of any nature whatsoever arising in connection with the fulfilment of any Prize; (b) Winner(s) including for on behalf of the Companion hereby releases Company, Company Entities, and Sponsor from any and all liability arising out of any personal injuries, property loss or damage, and misuse of the Prize offered under this Contest, whether directly or indirectly, by reason of the acceptance, possession, or participation in the Contest including during shipping of the Prize to the Winner (if applicable).

11. In case Participant(s) and/or Winner(s) fail to produce any documents required by Company for the purpose of verification of compliance with these Terms and Conditions, such Participant(s) and/or Winner(s) shall stand disqualified without any liability to Company.

12. The Prizes are non-refundable, non-transferrable and non-exchangeable. For the purpose of clarity, no cash equivalent or alternative prize shall be given to the Winner(s)/ their Companion and the Winner(s) cannot exchange the Prize(s) for a gift of equivalent value and/or liquidate the Prize in the form of cash, monies or any other nature of interests. The Prize cannot be clubbed or modified or changed. Further, the Prize won is personal to the Winner(s) and the Winner(s) cannot transfer the Prize to any other person(s) save for sharing the Prize with a companion of their choice (“Companion”) subject to the Contest Terms.

13. The Companion must be: (i) an individual, resident of UAE and not citizen of any sanctioned country (where sanctioned country means Belarus, Burma (Myanmar), Crimea, Cuba, Democratic Republic of Congo, Iran, Ivory Coast, Liberia, North Korea, Somalia, Sudan, Syria, Zimbabwe and any other country against whom the U.S. economic sanctions are or may be maintained by the U.S. Government, as may be updated from time-to-time); and (ii) must be aged 18 (eighteen) years or above.

(IV) Consent for procuring Personal Information

In connection with participating in the Contest organized by Company You hereby provide Your consent for collection, storage, use, transfer and retention by Company and/or Company Entities of your personal information and sensitive personal data or information as defined under applicable laws, as may be amended from time to time (collectively, “Personal Information”), including but not limited to, information in relation to Your participation in the Contest, information including Personal Information and data provided by You and/or gathered under, or pursuant to this Contest by Company such as your phone number, address, email address etc., which Personal Information is subject to Company’s personal data privacy policy available at https://www.disneystar.com/legal-terms-policies/terms/contest-terms-conditions/wish-movie-contest-same-privacy-policy/ which You have read and understood. Additionally, You agree and acknowledge the following and consent to all of the below:

a) Your Personal Information (including but not limited to your name, age, your username, location/city, email-ID, phone number and address) may be collected by Company or any or all of Company Entities, pursuant to the Contest Terms, in connection with the Contest. You hereby also agree that it may be/become necessary for Company and/or Company Entities to collect the Personal Information in connection with Your participation in the Contest and for the uses set out below. Your refusal to provide Company and/or Company Entities (as the case may be) with certain information would entitle Company to disqualify You form participation in the Contest.

b) Your Personal Information will be used, collected, disclosed, transferred, retained by Company and/or Company Entities for the Contest, including for the purposes of administration of the Contest and for promotional/gratification purposes around the Contest and for no other purpose.

c) Your Personal Information may be used for purposes in connection with and related to the Contest including in relation to Your participation in the Contest and administering the Contest, including for any promotional/ gratification purposes around the Contest. Your Personal Information may be used by Company and/or Company Entities in various formats and media, including television, digital, social media, print for marketing and promotional activities in respect of the Contest.

d) Company has informed you of Your rights to: (i) review Your Personal Information for deficiencies and inaccuracies, and request Company to amend the Personal Information, to the extent deemed feasible by Company; and (ii) withdraw the consent provided hereunder, provided that Company/ Company Entities shall not be liable for any collection, storage, use, transfer or disclosure of Personal Information prior to such withdrawal of consent or request for amendment of Personal Information. Additionally, upon any such withdrawal of consent or request to review and amend Your Personal Information, Company shall be entitled to disqualify Your Entry and/or participation in the Contest, as deemed fit and necessary by Company at its sole discretion.

e) All Your Personal Information is true, correct and complete in all respects, and in no circumstances will Company and/or Company Entities be liable for either the authenticity of the Personal Information or any inaccuracies or deficiencies in your Personal Information.

f) Company has provided you with the option to opt out of providing Your Personal Information.

g) You expressly acknowledge that Personal Information may be shared by Company and/or Company Entities with law enforcement agencies and/or other applicable authorities for compliance with legal obligations.

h) You hereby agree to abide by the Contest Terms.

(V) Additional Terms:

1. The Winner(s) shall also be required to comply with the terms and rules as may be published, displayed and/or communicated by Company, from time to time.

2. Company reserves all rights to make amendments to the existing Contest Terms including without limitation change in the rules and structure, any element of the Content, the number of winners, nature of the Prize, dates and timelines for the Contest etc. (“Revised Terms”) or to reschedule, cancel, terminate or withdraw the Contest without giving prior notice. Any such change may be updated on Social Media Pages. It shall be the sole responsibility of the Participant(s) check the Contest Terms on the website of Company and the Social Media Page. The Revised Terms (if any) shall supersede all prior Contest Terms.

3. Nothing contained herein or otherwise imposes an obligation on Company to run the Contest, declare winners and/or distribute the Prize. Further, Company reserves the rights to terminate or temporarily suspend the Contest at any time, with or without notice, for any reason whatsoever.

4. Under no circumstances will Company, Company Entities and/or Sponsor be liable for any consequential, indirect, special, punitive, or incidental damages or lost profits, whether direct or indirect, arising in any way whether in contract, tort (including negligence) or otherwise.

5. The Participant(s) and/or the Winner(s) hereby acknowledge and agree that the relationship between the Participant(s) and/or the Winner(s) and Company is not a confidential, fiduciary, or other special relationship. Nothing herein shall be deemed to create a partnership, agency or an employer-employee relationship between the Participant and Company.

6. The Participants will, at all times, engage in conduct with due regard to social conventions and public morals and will not commit any act which could bring Company, Company Entities, and/or Sponsor into public disrepute or reflect unfavourably on any such parties.

7. All Entries shall become the property of Company and/or Company Entities. By entering the Contest, the Participant(s) and/or the Winner(s) grant Company and Company Entities unlimited right to use of their names, social media handles, address, voice, photographs, statements and/or likeness including the Entry in any and all media without remuneration throughout the world in perpetuity for the purpose of publicity and/or advertising.

8. For the sake of clarity, all rights, title and interest in Entry shall vest with Company and may be utilized by Company at a later point in time, at its sole discretion. The Participant(s) and/or the Winner(s) hereby irrevocably, perpetually and for the entire world, assign all rights, title and interest including rights in any intellectual property vested in the Entry to Company including but not limited to the right to make any adaptation, rights in any form of exploitation etc.

9. Except as expressly provided herein, all ancillary costs associated with the receipt or use of the Prize, whether direct and/or indirect, including without limitation charges, expenses, taxes, costs, etc. are the sole responsibility of the selected Winner(s).

10. By providing any Personal Information to Company and/or entering the Contest, each Participant thereby waives their privacy rights and/or any privacy expectations they have with respect to the use of their likeness or personal information furnished to Company. If a Participant does not wish to have their information and/or likeness viewed by or disclosed to others, they should not enter the Contest.

11. Participants agree to not host, display, upload, modify, publish, transmit, update or share any information that belongs to another person and to which the user does not have any right to, infringes any patent, trademark, copyright or other proprietary rights, impersonates another person, is invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging and/or violates any law for the time being in force,

12. Company will not be liable to You for delay or failure to perform its obligations set out hereunder caused by an event of natural disaster, acts of God, riots, terrorism, or such other event that is beyond the reasonable control of Company. The Winner(s) agree that if due to any reason, whatsoever, beyond the control of Company the Prize and/or anything in connection to the Prize and/or the enjoyment of the Prize becomes ineffective or invalid, Company cannot be held responsible and/or liable for the same.

13. Company is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, illness, infection, death, mental trauma caused to the Participant(s) and/or the Winner(s) and their respective Companion(s) in any manner whatsoever or for any reason whatsoever in connection to the Contest and/or Prizes.

14. The Winner(s) shall do and cause their Companion to do any and all acts and execute any and all documents in such manner as may be required by Company in its sole and absolute discretion to protect, perfect or enforce any of the rights granted or confirmed to Company failing which their selection shall be forfeited.

15. If any provision of these Contest Terms is unenforceable or invalid under applicable laws, the said provision shall be modified to the extent necessary, and in any event, the remaining provisions will continue to be valid and enforceable.

16. The Participant(s) and/or the Winner and/or the Companion shall fully indemnify, defend and hold harmless and keep indemnified, Company, its affiliates, officers, directors, employees and agents and the Sponsor (if applicable) (collectively the “Indemnified Persons”) from and against any and all losses, claims, actions, damages, liabilities, penalties, costs and expenses, (including without limitation reasonable attorneys’ fees and court fees) (collectively “Losses”), that the Indemnified Person may incur or suffer or likely to incur or suffer as a result of or arising out any (i) breach of any terms hereunder; (ii) wilful misconduct or negligent acts or omissions; and/or (iii) any claims by any third party for any losses, damages, costs, expenses, injuries suffered by such third party, arising out of or in relation to the Participant(s) and/or the Winner and/or the Companion during the Contest and/or enjoyment of the Gratification. Under no circumstances will Company Entities be liable for any consequential, indirect, special, punitive, or incidental damages or lost profits, whether direct or indirect, arising in any way whether in contract, tort (including negligence) or otherwise.

17. By participating in the Contest, it shall be construed that the Participant(s) and/or the Winner(s) and their respective Companion(s) have waived their right to raise any dispute with regard to the Contest and/or the Prizes and/or any decision of Company, in any manner whatsoever, to the maximum extent permissible by applicable law.

18. The Contest shall be governed by and construed in accordance with the applicable laws of the United Arab Emirates. All matters with respect to the Contest are subject to the exclusive jurisdiction of the courts at Dubai.

19. To the fullest extent permitted by law, Company including its affiliates, and each of their respective officers, directors, employees, third party service providers, and agents disclaim all warranties, express or implied, in connection with the Contest and the Prize. Company makes no warranties or representations about the accuracy or completeness of content advertised by the Sponsor or the content of any websites linked to Company and assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies on Company/ Company Entities; and/or (ii) personal injury or property damage, of any nature whatsoever, resulting from the Participant’s participation in the Contest; and/or (iii) personal injury, illness, infection, death, mental trauma caused to the Winner/ the Companion in relation to their enjoyment of the Prize; and/or (iv) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available by Company/ Company Entities, whether based on warranty, contract, tort, or any other legal theory, and whether or not the Participant is advised of the possibility of such damages. The foregoing shall apply to the fullest extent permitted by law in the applicable jurisdiction.

20. Limitations of Liability: By entering the contest, each Participant (which shall include all Winners) acknowledges and agrees that: (i) any and all disputes, claims and causes of action arising out of or in connection with the Contest, or any Prizes awarded, shall be resolved individually, without resort to any form of class action; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and associated with entering the Contest (if any). Notwithstanding the foregoing, under no circumstances will Company and/or Company Entities be liable for any consequential, indirect, special, punitive, or incidental damages or lost profits, whether direct or indirect, arising in any way whether in contract, tort (including negligence) or otherwise. The Participant’s participation in the Contest shall be at the Participant’s sole risk. The Participant acknowledges that the representations and warranties, indemnities, limitation of liability, governing law, dispute resolution, warranty disclaimer shall survive the efflux of time.

21. Any complains and/or questions in relation to the Contest and/or these Contest Terms should be sent to Company in writing and in English and to be sent:
